If you contact them without explicit permission, you could be in breach of the rules.<\/p>\n<p>Though it may sound like a hassle, gaining real consent will not only avoid hefty fines \u2013 it can actually help build customer trust and engagement in the long run.<\/p>\n<p>&nbsp;<\/p>\n<p>To obtain compliant consent for your marketing communications, follow these steps:<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Clients must actively \u2018opt in\u2019<\/strong><br \/>\nHowever you currently collect your data, you will need to get rid of forms which pre-populate the \u201cI agree to be contacted for marketing purposes box\u201d, or which state providing details gives consent by default.Clients and prospects must\u00a0<strong>actively opt in<\/strong>\u00a0to communications, for example by ticking a box which agrees to a\u00a0<strong>clear and specific <\/strong>communication method.Consent requests should be kept separate from other terms and conditions.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Ask your existing database<br \/>\n<\/strong>You\u2019ll need to ask your existing contacts whether they are happy to continue receiving marketing updates. They may have already agreed, if they have specifically opted in.But those who are contacted purely because they have given you their details or use your service, but haven\u2019t agreed to marketing updates, will need to do so before you can contact them post-GDPR.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li><strong>Are you contacting a customer with information essential to your service?<\/strong><br \/>\nThough you\u00a0<strong>CAN\u2019T\u00a0<\/strong>contact customers who haven\u2019t opted in for marketing purposes, you\u00a0<strong>CAN<\/strong>\u00a0communicate details which are essential to the service you\u2019re providing to them.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Make it clear that individuals can refuse or withdraw consent<\/strong><br \/>\nRequests for consent should use plain language, and should explain:<br \/>\n\u2013 Why you want the data and what you will do with it<br \/>\n\u2013 The name of your organisation and any third party controllers<br \/>\n\u2013 That individuals can refuse consent without it affecting their service<br \/>\n\u2013 That individuals can withdraw their consent in future, and how to do this<\/li>\n<\/ul>\n<p>If you are unsure about any of these points, always refer to official guidance from the Information Commissioner\u2019s Office (<span style=\"text-decoration: underline\"><strong><a href=\"https:\/\/ico.org.uk\/\">ico.org.uk<\/a><\/strong><\/span>).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The way you currently contact your clients and prospects is changing, with the introduction of the EU General Data Protection Regulation (GDPR) in May 2018.
